Overland Park Spousal Support - Maintenance - Alimony Lawyer

In Kansas spousal support - maintenance - alimony is available on a case-by-case basis. The court looks at the need of the party whose income or resources are less for such support, and it also looks at the ability to pay such support by the party in the marriage whose income or resources is greater than the spouse seeking support. The court will order an amount the court finds to be fair, just and equitable under all of the circumstances. These payments are modifiable or terminable under circumstances described in the divorce decree. A request for such support is retroactive to a date at least one month after the date that the request was filed with the court. The maximum amount of support one can receive cannot exceed 121 months.

In Missouri the court may order maintenance for a permanent or temporary period after considering all economic relevant factors including: (1) The financial resources of the party desiring support (2) The time necessary to acquire sufficient education or training to enable the party seeking maintenance to find appropriate employment; (3) The earning capacity of each spouse; (4) The standard of living established while married; (5) The financial obligations and resources of each spouse; (6) The length of the marriage; (7) The age and health condition of the spouse seeking maintenance; (8) The ability of the spouse from whom maintenance is sought to meet his needs while meeting those of the spouse seeking maintenance; (9) The conduct of the parties during the marriage; and (10) Any other relevant factors. The maintenance order must state if it is modifiable or non-modifiable. The court may order maintenance which includes a termination date. Unless the maintenance order which includes a termination date is non-modifiable, the court may order the maintenance decreased, increased, terminated, extended, or otherwise modified based upon a substantial and continuing change of circumstances which occurred prior to the termination date of the original order.
