Gaining Accurate Information
In order to know how to properly divide property and other assets as well as debt, I need to gain a clear and accurate picture of your household financial situation. When you come to my office to discuss property division I may have you bring with you supporting documentation showing both assets and liabilities. I also use a special Internet website that you can go to that allows you to provide me, from the comfort of your home, with all of the necessary information about your marital and non-marital property, assets and debts and the parenting plan you desire so that I can then devise a strategy that is best for you. This may include the current outstanding value of your home mortgage and the value of the home on the date of the separation as well as for all other assets. I will make a discovery request of opposing counsel and examine credit card and other debt. If your spouse is reluctant to provide this information, I can subpoena business records through the court's authority to obtain the information we need.
I have assisted clients in cases where a spouse has run up bills after a separation in an attempt to have the liability factored into the overall marital debt.
Sifting Through Marital and Non-Marital Assets
I employ the same software the Kansas and Missouri courts use to determine which assets and debts are marital and which are non-marital. By looking at your property in the way the court will, I am able to give you an accurate picture of which assets are yours and which are marital property. From this understanding we can begin to negotiate a division plan.
I look forward to speaking with you about property division matters associated with your divorce and helping you find resolution so that you can successfully move forward. Contact the Law Firm of Kevin Stuart Cavanaugh today and schedule a free initial consultation. Call (913) 387-3193.
